A resposta \u00e9 \u00f3bvia: precisa de muitas coisas, de muita criatividade e de algumas tr\u00e9guas do legislador laboral. Centremo-nos nas altera\u00e7\u00f5es ao C\u00f3digo do Trabalho \u2013 que, como sabemos, n\u00e3o \u00e9 sofisticado e n\u00e3o estava preparado para contextos de crise \u2013 marcando os \u00faltimos dois anos num loop esquizofr\u00e9nico de altera\u00e7\u00f5es e interpreta\u00e7\u00f5es, aplica\u00e7\u00f5es desviantes e falta de rigor, perante o incomodativo sil\u00eancio das autoridades competentes. Apesar da loucura legiferante aliada a uma pandemia sem precedentes, as empresas (algumas) aguentaram-se.Chegados ao ano 2021, e come\u00e7ando pela tem\u00e1tica do teletrabalho, foram dez as propostas de lei que chegaram ao Parlamento e que s\u00e3o suscet\u00edveis de afetar sobejamente os empregadores deste pa\u00eds. \u00c0 laia de transforma\u00e7\u00e3o do C\u00f3digo do Trabalho numa manta de retalhos, assistimos recentemente a uma pan\u00f3plia de propostas de novas altera\u00e7\u00f5es, revers\u00f5es e retrocessos.O contexto pand\u00e9mico foi, portanto, mote \u2013 ou desculpa \u2013 para muita coisa mal feita. Mas tamb\u00e9m evidenciou um conjunto de oportunidades, onde destacamos a tecnologia. Se (ainda) faltavam motivos para fazermos a transi\u00e7\u00e3o digital, eles sobraram com a pandemia. O grande exemplo foi o teletrabalho, com a sua ado\u00e7\u00e3o em larga escala e, em muitos contextos, a sua obrigatoriedade.A quarta revolu\u00e7\u00e3o industrial j\u00e1 chegou e n\u00f3s j\u00e1 somos atores em todo o seu contexto \u2013 embora uns estejam mais preparados do que outros. E se as empresas tiverem a coragem de olhar para o seu futuro (que come\u00e7ou ontem) sem as amarras a que est\u00e3o acostumadas? Por que n\u00e3o adotarem planos de governance laboral mais sofisticados do que aqueles que s\u00e3o propostos por terceiros? Refiro-me a um compliance laboral e tecnol\u00f3gico, que permita \u00e0s empresas fazerem o match entre as obriga\u00e7\u00f5es legais, as necessidades organizacionais, os direitos e os deveres dos trabalhadores e as oportunidades tecnol\u00f3gicas. N\u00e3o pretendo fazer qualquer tipo de cenariza\u00e7\u00e3o, mas h\u00e1 j\u00e1 poucas d\u00favidas acerca dos impactos da tecnologia no contexto das rela\u00e7\u00f5es laborais nos pr\u00f3ximos anos.<\/p>\n<p>        PUB \u2022 CONTINUE A LER A SEGUIR<\/p>\n<p>        Por isso, a aposta na forma\u00e7\u00e3o profissional e no capital humano n\u00e3o dever\u00e1 escapar ao gestor do s\u00e9culo XXI. E urge evitar algumas tend\u00eancias de terceiro mundo \u2013 mais uma vez, porque o mindset dos nossos gestores n\u00e3o est\u00e1 alinhado com as boas pr\u00e1ticas laborais e tecnol\u00f3gicas \u2013 colocando entidades patronais e trabalhadores a lutar por cr\u00e9ditos de horas de forma\u00e7\u00e3o em contexto de cessa\u00e7\u00e3o do contrato de trabalho, surgindo o trabalhador a exigir quantias a t\u00edtulo de forma\u00e7\u00e3o devida e n\u00e3o ministrada. Em plena quarta revolu\u00e7\u00e3o industrial, ter\u00e1 de ser a lei a obrigar as empresas a um m\u00ednimo de horas de investimento em capital humano? A falta de investimento em forma\u00e7\u00e3o n\u00e3o sair\u00e1 mais cara no final das contas? Para as empresas, as vantagens de serem, simultaneamente, laboral e tecnologicamente \u201ccompliant\u201d s\u00e3o in\u00fameras: cumprem uma obriga\u00e7\u00e3o legal, evitando penalidades, ret\u00eam talento, capacitando e qualificando os seus trabalhadores, que s\u00e3o j\u00e1 for\u00e7osamente trabalhadores da era digital, e contribuem para o desenvolvimento e sucesso da sua atividade.\u00c9, pois, urgente para as empresas a ado\u00e7\u00e3o de um modelo de compliance laboral e tecnol\u00f3gico, onde a forma\u00e7\u00e3o profissional, acoplada \u00e0 tecnologia, tenha o destaque merecido. N\u00e3o pode haver forma\u00e7\u00e3o para cumprir calend\u00e1rio, subordinando-a, muitas vezes, a temas enfadonhos ou desatualizados apenas para \u2018\u2019ingl\u00eas ver\u2019\u2019 ou, melhor dizendo, para \u2018\u2019a ACT ver\u2019\u2019.
